S. 39. “Voluntarily” under IPC

A person is said to cause an effect “voluntarily” when he causes it by means whereby he intended to cause it, or by means which, at the time of employing those means, he knew or had reason to believe to be likely to cause it.

In order to facilitate a heist, A sets fire to an occupied residence in a big city late at night, killing someone in the process. Even though A may not have wanted to cause death in this situation and may even regret doing so, he has caused death voluntarily if he was aware that it was likely to happen.

A person need not plan to cause a certain consequence, according to a simple reading of this provision. Whether or not somebody truly intends to cause an act, he is said to have caused it deliberately if it is the likely result of the methods he employed to produce it. Section implicitly lays down the principle that a man is presumed to intend the probable consequences of his act.
